Some Obstacles of Constructing and Understanding the Texts of Fiqh Correctly and the Exemplary of al-Hidaya in Overcoming These

In our study, some historical and scientific reasons and obstacles that make understanding and constructing text difficult were examined by pointing to the variable field with the fixed field of fiqh, and an evaluation was made based on the exemplary of Merginani's al-Hidaya in overcoming these. In the history of fiqh, the fact that texts are generally constructed by blending the verses and the nature of the construction of texts by this method have been pointed out. In addition, it was emphasized why Muslims could not be succesfull in constructing texts in some periods, while showing reflexes and achieving this following the difficulties they had in some periods of history. It has been highlighted that constructing a text requires appropriate conditions and that a text cannot be easily formed with small pieces; accordingly illustrations and examples are given. It was underlined that besides his own accumulation of knowledge, the conditions surrounding him was also effective in the success of Merginani in the construction of the text. While identifying the reasons for the shortness of the texts in our tradition that impede understanding, traditional text has been compared with the texts written today.

Fıkıh Metinlerini Doğru Anlamanın ve Metin İnşâ Etmenin Bazı Engelleri ve Bunları Aşmada el-Hidâye’nin Örnekliği

Çalışmamızda fıkhın sabit alanıyla değişken alanına işaret edilip anlamayı ve metin inşasını zorlaştıran bazı tarihî ve ilmî sebepler ve engeller incelenmiş ve bunları aşmada Merginânî’nin el-Hidaye’si örnekliğinden hareketle bir değerlendirme yapılmıştır. Fıkıh tarihinde metinlerin genelde nasların harmanlanmasıyla inşa edildiğine ve bunun mahiyetine işaret edilmiştir. Ayrıca Müslümanların tarihin bazı dönemlerinde geçirdikleri sıkıntıları müteakip refleks gösterip yeni ve başarılı metinler inşa ederken bazı dönemlerde neden bu başarıyı gösteremedikleri üzerinde durulmuştur. Metin inşa etmenin külli bir durum olup cüzi parçalarla kolayca oluşamayacağı vurgulanmış ve bu doğrultuda nazireler ve misaller verilmiştir. Merginânî’nin metin inşasındaki başarısında kendi birikimi yanında onu kuşatan şartların da etkili olduğu ihsas edilmeye çalışılmıştır. Geleneğimizdeki metinlerin anlamaya halel getiren kısalığının sebeplerine işaret edilirken günümüzde yazılan metinlerle mukayesesine de gidilmiştir.
